Petitions for child support usually accompany divorce or legitimation actions, but they can also arise in cases where the parents never married, there is no legitimation or divorce action pending, and the mother seeks child support from the biological father. Calculations of child support are made using a Child Support Worksheet based on statutory Child Support Guidelines. Income of both parties, responsibility for payment of uncovered medical expenses, and certain expenses for children called Deviations (childcare, private school, extra-curricular activities, etc.) are entered on the Worksheet to calculate a presumptive child support amount. Child support lasts until a child graduates from high school, so long as the child is not over twenty years of age. In certain circumstances, child support may be garnished directly from the noncustodial parent’s wages pursuant to an Income Deduction Order entered by the Court.
