Contempt actions arise where there is already a Final Order or Final Judgment in a divorce, modification, or legitimation case, and one spouse has violated an existing, filed Order. Violations may include failure of one party to pay child support, alimony, or property division payments, to follow custody and visitation arrangements, to effectuate documents to facilitate the transfer of title to real estate or vehicles, etc. Remedies may include payment of money arrearages, make up or adjustment of visitation, payment of the other party’s attorneys’ fees, and even incarceration.
